This Privacy Policy describes the privacy practices of Impulse Labs, Inc. (“Impulse,” “we”, “us”, or “our”) and how we handle personal information that we collect through our website and any other sites or services that link to this Privacy Policy (collectively, the “Service” or “Services”), as well as our cooktop and other appliances (collectively, the “Products”).

Aspects of this Privacy Policy may be more relevant to you depending on how you interact with us (for example, we collect certain categories of data if you are a website visitor and different categories of data when you purchase or use our Products).

Personal information we collect

Information you provide to us:

Contact information, such as your first and last name, email and mailing addresses, and phone number.
Product usage information, such as information about how you use our Products, including telematics from our Products (which may be used to derive general location information) and information you provide when you use any interactive features of the Services. As part of your use of the Products and to help us tailor your experience, we may also collect information about your dwelling, such as the size, number of rooms, and other related information.
Payment and transaction data, needed to complete your orders on or through the Service (including name, payment card information, and billing information), and your purchase history. Your payment card information is processed by our payment provider, Shopify.
Feedback or correspondence, such as information you provide when you contact us with questions, feedback, Product reviews, or otherwise correspond with us online, via email, social media, or otherwise.
Marketing information, such as your preferences for receiving communications about our activities, events, and publications, and details about how you engage with our communications.

Information we obtain from third parties:

Partners. We may obtain limited information, such as Product Usage Information, from our third-party sales partners.
Social media information. We may maintain pages on social media platforms, such as Facebook, LinkedIn, Instagram, and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use and processing of your personal information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy.
Other Sources. We may obtain your personal information from other third parties, such as marketing partners, advertising networks, publicly available sources, and data providers/brokers.

Automatic data collection. In addition to the Product usage data described above (which includes IP address and telematics data), we and our service providers may automatically log information about you, your computer or mobile device, and your interaction over time with our Services, our communications, and other online services, such as:

Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 4G), and general location information such as city, state or geographic area.
Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, browsing history, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access, and whether you have opened our marketing emails or clicked links within them.

Some of this data is collected automatically through cookies and similar technologies:

Cookies, which are text files that websites store on a visitor’s device and that allows web servers to record users’ web browsing activities and remember their submissions, preferences, credentials, and login status as they navigate a site. Cookies used on our sites include both “session cookies” that are deleted when a web browser session ends, “persistent cookies” that remain longer, “first party” cookies that we place, and “third party” cookies that our service providers and other third parties place.
Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.
Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed, forwarded, or opened, or that certain content was viewed or clicked.
Session-replay technologies, such as those provided by third parties that employ software code to record users’ interactions with the Services in a manner that allows us to watch video replays of those user sessions. The replays include users’ clicks, mobile app touches, mouse movements, and scrolls during those sessions. These replays help us diagnose usability problems and identify areas for improvement.

How we use your personal information

Service delivery and operations. We may use your personal information to:

provide and operate the Service (including to process your orders and transactions and ship and service our Products);
enable security features of the Service; and
communicate with you about our Services, including by sending you announcements, updates, security alerts, and support and administrative messages, and responding to your requests, questions, and feedback.

Service personalization. We may use your personal information to personalize the Service for you, which may include using your personal information to:

personalize your experience with the Service and our Service-related communications; and
remember your selections and preferences as you navigate the Service.

Service improvement and analytics. We may use your personal information to analyze your usage of the Service, improve the Service, improve the rest of our business, help us understand Product usage and user activity on the Service, including which pages are most and least visited and how visitors move around the Service, as well as user interactions with our emails, and to develop new products and services.

To create aggregated, de-identified and/or anonymized data. We may create aggregated, de-identified, and/or anonymized data from your personal information. We make personal information into de-identified and/or anonymized data by removing information that makes the data identifiable to you. We may use and share this data with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.

Marketing and advertising. We and our advertising partners may collect and use your personal information for marketing and advertising purposes, including:

Direct marketing. We or our advertising partners may from time-to-time send you direct marketing communications as permitted by law, including, but not limited to, notifying you of special promotions, and offers via email, text message, and other communication channels. You may opt out of our marketing communications as described in the “Opt out of marketing communications” section below.
Interest-based advertising. We and our third-party advertising partners may use cookies and similar technologies to collect information about your interaction (including the data described in the “Automatic data collection” section above) with the Services, our communications and other third-party online services over time, and use that information to serve online ads that they think will interest you. This is called interest-based advertising. We may also share information about our users with these companies to facilitate interest-based advertising to those or similar users on other online platforms. You can learn more about your choices for limiting interest-based advertising in the “Online tracking opt-out” section below.

To comply with law. We may use your personal information as we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities. We may also audit our internal processes for compliance with legal and contractual requirements or our internal policies.

For compliance, fraud prevention, and safety. We may use your personal information to: (a) protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (b) enforce the terms and conditions that govern our Services; and (c) protect, identify, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity, including cyber attacks and identity theft.

With your consent. In some cases, we may specifically ask for your consent to collect, use, or share your personal information for further purposes, if those purposes are not compatible with the initial purpose for which that personal information was collected.

Cookies and similar technologies. In addition to the other uses in this section, we may use the cookies and similar technologies described above for the following purposes:

Technical operation. To allow the technical operation of the Service.
Functionality. To enhance the performance and functionality of our services.
Analytics. To help us understand user activity on the Service, including the volume and demographics of users, which pages are most and least visited and how visitors move around the Service, as well as user interactions with our emails.

How we share your personal information

We may share your personal information with the following parties and as otherwise described in this Privacy Policy, in other applicable notices, or at the time of collection:

Affiliates. We may share your personal information with our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Policy.

Service providers. We may share your personal information with third party companies and individuals that provide services on our behalf or help us operate our Services (such as customer support, text message and call recording providers, hosting, analytics, email delivery, marketing, and database management services).

Payment processors. Any payment card information you use to make a purchase on the Service is collected and processed directly by our payment processors, such as Shopify. Shopify may use your payment data in accordance with its privacy policy, available at https://www.shopify.com/legal/privacy.

Third-party sales partners, such as retailers of our Products.

Advertising partners. We may share your personal information with third party advertising companies, including for the interest-based advertising purposes described above.

Professional advisors. We may disclose your personal information to professional advisors, such as lawyers, bankers, auditors and insurers, where necessary in the course of the professional services that they render to us.

Third parties designated by you. We may share your personal information with third parties where you have instructed us or provided your consent to do so.

Authorities and others. We may share your personal information for the compliance, fraud prevention and safety purposes described above.

Business transfers. We may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution. For example, we may need to share certain personal information with prospective counterparties and their advisers. We may disclose your personal information to an acquirer, successor, or assignee of Impulse Labs or a portion of our business assets as part of any merger, acquisition, sale of assets, or similar transaction, and/or in the event of an insolvency, bankruptcy, or receivership in which personal information is transferred to one or more third parties as one of our business assets.

Your choices

Access or update your information. If you have registered for an account with us, you may review and update certain personal information in your account profile by logging into the account.

Opt out of marketing communications. You may opt out of marketing-related communications by following the opt-out or unsubscribe instructions within the communication or by contacting us at notices@impulselabs.com. You may continue to receive service-related and other non-marketing communication even after you opt out of marketing. You may opt-out of text messages by texting “STOP” in response to a text that you receive or by other reasonable means.

Online tracking opt-out. There are a number of ways to opt out of having your online activity and device data collected through our Services, including your ability to limit the user of your information for interest-based advertising purposes, which we have summarized below:

Blocking cookies in your browser. Most browsers let you remove or reject cookies, including cookies used for interest-based advertising. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Blocking advertising ID use in your mobile settings. Your mobile device settings may provide functionality to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.
Using privacy plug-ins or browsers. You can block our Services from setting cookies used for interest-based ads by using a browser with privacy features, like Brave, or installing browser plugins like Privacy Badger, DuckDuckGo, Ghostery or uBlock Origin, and configuring them to block third party cookies/trackers.
Platform opt-outs. Google Analytics. The Services use Google Analytics to understand how people engage with and use the Services. For more information on Google Analytics, click here. You can opt out of Google Analytics by downloading and installing the browser plug-in available at: https://tools.google.com/dlpage/gaoptout.

Note that because these opt-out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use.

Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” or similar signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

Declining to provide information. We need to collect personal information to provide certain services. If you do not provide the information we identify as required or mandatory, we may not be able to provide those services.

Shine the Light law opt out. Under California’s Shine the Light law (California Civil Code Section 1798.83), we give you the right to opt-out of our disclosure of your personal information (as defined by this law) to third parties for their direct marketing purposes. You may send us requests to notices@impulselabs.com. In your request, you must include the statement “Shine the Light Request," and provide your first and last name and mailing address and certify that you are a California resident. We reserve the right to require additional information to confirm your identity and California residency.

Other sites, mobile applications, and services

Our Services may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third party websites, mobile applications or online services, and we are not responsible for their actions. Other websites and services follow different rules regarding the collection, use and sharing of your personal information. We encourage you to read the privacy policies of the other websites and mobile applications and online services you use.

Security practices

We use reasonable organizational, technical and administrative measures designed to protect against unauthorized access, misuse, loss, disclosure, alteration and destruction of personal information we maintain. Unfortunately, data transmission over the Internet cannot be guaranteed as completely secure. Therefore, while we strive to protect your personal information, we cannot guarantee the security of personal information.

Children and teens

Our Services are not intended for use by children or teens under 18 years of age. If we learn that we have collected personal information through the Services from a child or teenager under 18 without the consent of the parent or guardian where required by law, we will delete it.

International users

By using our Services, you understand and acknowledge that your personal information will be transferred from your location to our facilities and servers in the United States.

Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on our Services. We may also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via e-mail (if you have an account where we have your contact information) or another manner through our Services.

Any modifications to this Privacy Policy will be effective upon our posting the policy and/or upon implementation of the new changes on our Services (or as otherwise indicated at the time of posting).
